Terms of Use

By downloading, installing, or using the 11+ Vocab Master mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (the user) and 11 Plus Apps LTD ("we," "our," or "us") regarding your use of the App.

1. Description of Service

11+ Vocab Master is an educational vocabulary learning application designed to help students prepare for UK 11+ grammar school entrance examinations. The App provides:

• Interactive vocabulary flashcards with audio pronunciation
• Multiple practice modes and exercises
• Educational games for vocabulary learning
• Mock tests simulating 11+ exam conditions
• Progress tracking and performance analytics

2. Subscription Terms

2.1 Free Features

The App offers limited free content including the first vocabulary category with 20 words. This allows you to try the App before subscribing.

2.2 Premium Subscription

Premium features require a paid subscription. Available subscription options include:

• Monthly subscription
• 6-Month subscription
• Yearly subscription

2.3 Payment and Auto-Renewal

Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the current subscription price.

2.4 Managing Subscriptions

You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase. Cancellation of the current active subscription period is not allowed.

2.5 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for the unused portion of any subscription period. If you are eligible for a refund under Apple's policies, you must request it directly from Apple.

2.6 Free Trial

If a free trial is offered, you will be charged the subscription price after the trial period ends unless you cancel before the trial period expires. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

3. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Share your account credentials with others
• Attempt to circumvent subscription requirements or access premium content without payment
• Use the App in any way that could damage, disable, overburden, or impair the service
• Reverse engineer, decompile, or attempt to extract source code from the App
• Copy, reproduce, redistribute, or resell content from the App without permission
• Use automated systems or software to extract data from the App
• Remove or modify any copyright, trademark, or proprietary notices

4. Intellectual Property Rights

All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, vocabulary lists, definitions, examples, software, and the compilation thereof, is the property of 11 Plus Apps LTD or its content suppliers and is protected by UK and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the App for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without express written permission from 11 Plus Apps LTD

5. Educational Use and Disclaimers

The App is intended as a supplementary educational tool to help students prepare for 11+ examinations. While we strive for accuracy and educational value in all our content:

• We make no guarantees regarding exam results, academic performance, or admission to any school
• The content should not be considered a substitute for professional educational guidance, tutoring, or formal instruction
• Different schools and exam boards may have varying requirements and standards
• Parents and educators should supervise children's use and supplement with appropriate materials

7. Children's Use

The App is designed for children aged 7 and above. Parents or legal guardians must:

• Supervise their child's use of the App
• Accept these Terms on behalf of their child
• Be responsible for any purchases made through the App
• Monitor their child's learning progress and ensure appropriate use

We recommend that parents review the content and features with their children and establish guidelines for app usage.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

11 Plus Apps LTD DOES NOT WARRANT THAT:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from use of the App will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the App will meet your expectations
• Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 11 PLUS APPS LTD., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP
• DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

THIS LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE APP, FROM INABILITY TO USE THE APP, OR FROM INTERRUPTION, SUSPENSION, OR TERMINATION OF THE APP, AND SHALL APPLY WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App, via email, or by posting a notice on our website. The "Last Updated" date at the top of these Terms will be revised. Your continued use of the App after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App or any part thereof (including features, content, or pricing) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

12. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Conduct that we believe is harmful to other users, us, or third parties
• Violation of applicable laws or regulations
• Upon your request for such termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, we retain the right to bring legal proceedings in any jurisdiction where you reside or where a breach of these Terms occurs.

14. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@11plusapps.com. We'll try to resolve the dispute informally by contacting you via email.

If a dispute is not resolved within 30 days of submission, you or 11 Plus Apps LTD may bring a formal proceeding. Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the UK Arbitration Act 1996, except where prohibited by law or as otherwise specified in these Terms.

15. Apple App Store Terms

These Terms are between you and 11 Plus Apps LTD, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.

11 Plus Apps LTD, not Apple, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection legislation.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
